The domain is your website's address and also a form of branding. It belongs to you as long as you renew it, and it's the only part of your online presence that you can take with you if you switch providers. Therefore, it should always be registered in your name, not your agency's.
Two figures that matter in everyday life: Transferring .de domains between providers usually takes a few hours, but can take up to five days internationally. And after expiration, a .de domain isn't immediately gone; it undergoes a 30-day waiting period. So, if you forget to renew, you have a buffer, but you shouldn't rely on it.
